Terms and Conditions of Use

1. Acceptance

By accessing createwebtoday.com, creating an account, using the creation wizard, generating content with artificial intelligence, purchasing a plan, or publishing a site, you agree to these Terms and Conditions, our Privacy Notice and our Cookie Policy.

You must be at least 18 years old and have legal capacity to enter into contracts. If you act on behalf of a company, you represent that you have authority to bind it. If you do not agree, do not use the Service.

2. Definitions

• Platform or Service: the website, dashboard, API, visual editor, AI generation flows, checkout, publication tools, and administrative tools of CreateWebToday.
• User or Customer: a natural or legal person registered who creates or manages one or more Sites on the Platform.
• Site: a single-page website with multiple sections, generated or edited within the Platform and published under your domain (for example: home, services, contact, and location on the same URL). Includes its versions, files, and domain configuration. It does not include separate internal pages, a blog, an online store, or a booking system, unless expressly stated.
• Plan: a subscription (monthly or multi-month, for example 1, 2, or 3 years) that enables publication, hosting, SSL, and the associated services described at checkout.
• User Content: text, images, documents, contact details, instructions, and any material you upload or ask us to generate.
• AI-generated Content: text, structures, images, or HTML fragments produced automatically from your instructions.

3. Description of the Service

CreateWebToday allows you to:

• Create an account and complete a wizard with your business information.
• Upload images and reference documents.
• Generate website drafts with artificial intelligence.
• Preview, edit manually, and request AI changes.
• Purchase a Plan to publish your Site with a domain, hosting, and SSL certificate.
• Manage renewals, cancellations, and publication status from your dashboard.

Site type: the Service includes a single-page website with multiple sections. This is the format we offer for local businesses: the important information on one shareable link. It does not include separate internal pages, a blog, an online store, or a booking system, unless expressly stated.

Included domain: the Plan includes a standard domain subject to availability and prices shown at checkout. Premium domains have an additional cost and are disclosed expressly at checkout. Domain email, when available, is forwarding (for example hello@yourdomain) to your usual inbox; it does not include a full business mailbox such as Google Workspace. AI allowances are described in section 9 and domain email in section 8.

Usage model: you may generate and edit drafts before paying. Publication on the internet, the domain, and ongoing online availability depend on purchasing and maintaining the applicable Plan. The Service is provided as is and as available; it is not custom software development and does not guarantee business results, traffic, or search ranking.

4. Registration, account, and security

• You must provide accurate, current, and complete information.
• You may sign in with email (verification code) or Google OAuth, subject to availability.
• You are responsible for keeping your session confidential and for all use of your account.
• You must notify us immediately of any unauthorized access at admin@createwebtoday.com.
• We may suspend or close accounts showing signs of fraud, abuse, breach, or risk to the Platform or third parties, under section 17.

5. Plans, pricing, and billing

Current plans, prices, and durations are published on the pricing page and shown at checkout. Prices are stated in United States dollars (USD). Applicable taxes (if any) depend on your location and may be collected by Stripe or shown at checkout. We offer a monthly plan and multi-year plans (for example 1, 2, or 3 years).

• Payments are processed by Stripe. By paying you also accept Stripe’s applicable terms as an independent processor. CreateWebToday is not a bank or card issuer.
• The monthly plan is billed month to month and has a minimum commitment of 3 months. It is not refundable (see section 6.3).
• The Plan covers the services described at purchase on the then-current pricing page: publication, hosting, SSL certificate, editor, versions, and basic site administration, among others we expressly list.
• Unless expressly stated, the Plan does not include a Google Workspace–style mailbox, marketing campaigns, guaranteed SEO or traffic, custom graphic design outside the editor, or custom software development.
• An unjustified chargeback or payment dispute may result in suspension of the Site or account. If the charge was legitimate, you may remain obligated to pay the amount and related dispute costs.

5.1 Changes to plans, prices, and features

We may modify, replace, or discontinue plans, prices, AI credits, technical limits, included features, and providers at any time.

• For new purchases, what is published at the time of payment applies.
• For active subscriptions, changes to price, plan, or commercial terms may apply from the next renewal, with reasonable notice when practical. If you do not accept a change, you may cancel auto-renewal and use the Service until the end of the period already paid.
• We do not guarantee that a current price, allowance, or feature will remain available indefinitely. Disagreement with a future change does not create a right to a refund of the period already paid.

6. Renewal, cancellation, and refunds

6.1 Renewal

Plans are prepaid for the contracted period. We will email you with reasonable advance notice before a renewal, according to the Service’s operational schedule (for example 60, 30, 14, and 7 days beforehand, when applicable).

You may cancel auto-renewal from your dashboard so the Service does not renew at the end of the paid period. Canceling renewal does not undo the period already paid.

6.2 Effects of cancellation or expiration

• When the paid period ends without renewal, your Site may stop being published.
• A domain registered through the Platform may be subject to registrar rules and recovery or release timelines. We do not guarantee that you can recover it after expiration.
• We may retain certain information for legal, accounting, and security obligations, as described in the Privacy Notice.

6.3 Refund policy

You may request a refund from your subscriptions dashboard or by emailing admin@createwebtoday.com from your account email address.

If your request is approved, we refund the total amount paid minus $79 USD for standard domain registration, hosting, AI use, and service activation. If you purchased a premium domain, its price is also deducted: domain registration is annual, charged on activation, and cannot be cancelled or refunded at the registrar.

• Monthly plan: no refund. You must cover at least 3 months of service.
• After the first 7 days: no refunds of the period already paid.
• You may cancel automatic renewal at any time from your dashboard. Your Site remains active until the end of the contracted period and you will not be charged again when it ends, unless you reactivate renewal.
• No refund applies if we suspend or terminate the Service for fraud, abuse, violation of these Terms, or misuse, nor for interruptions, AI errors, DNS/SSL delays, or third-party failures.

Erroneous charges

If there was a duplicate charge or a verifiable billing error, contact us within 7 calendar days of the charge and we will correct it.

Approved refunds are processed through the same payment method (Stripe), within a reasonable time and subject to your financial institution’s timelines. Outside this section 6.3, CreateWebToday is not obligated to refund or indemnify for use of the Service.

7. Domains and publication

7.1 Included or suggested domain

Depending on the flow you choose, we may register a domain in your name through providers such as Cloudflare Registrar, subject to availability, registrar policies, and technical requirements. You must provide accurate and up-to-date registrant data; you are responsible to the registrar and third parties for that information.

Some TLDs may require manual registration or extra steps and do not have a fixed activation timeline.

7.2 Bring your own domain (BYOD)

If you connect a domain you already own, you must configure the DNS records we provide. Publication depends on your configuration, DNS propagation, and SSL activation. Incorrect DNS or DNS that stops pointing to the indicated target is your responsibility.

7.3 Transfers

If you request a domain transfer to or from the Platform, additional registrar or third-party fees may apply. We do not guarantee that a transfer will complete or the registrar’s timelines.

7.4 Availability and results

We do not guarantee that a domain name is available, that DNS/SSL will activate within a fixed time, or traffic, ranking, or commercial results of the published Site.

8. Domain email

For domains registered through the Platform we may offer aliases or forwarding (for example hello@yourdomain) to an address you designate. This is not a Google Workspace–style mailbox and does not guarantee delivery, retention, or suitability for critical legal notices.

If you connect your own domain (BYOD), forwarding is not configured by CreateWebToday: you must manage it with your DNS or email provider.

9. Use of artificial intelligence

• AI-generated content is an automated suggestion. You must review it before publishing. It is not legal, medical, financial, or other professional advice.
• You alone are responsible for the accuracy, legality, and truthfulness of what you publish (prices, promotions, contact details, notices, third-party intellectual property, etc.).
• We do not guarantee that content is error-free, unique on the internet, or compliant with sector-specific regulations.
• Each plan includes per-site AI allowances: up to 36 designs to choose from, 5 full-page regenerations with a new design, 20 full-page AI edits, and 10 AI-created images. Changing text and images in the visual editor does not use those allowances. We may apply or adjust additional technical limits to protect Service stability.

10. Intellectual property

10.1 Your content

You retain rights in User Content you upload or enter. You grant us a worldwide, non-exclusive, royalty-free license to host, process, transform, display, and publish that content solely to provide and operate the Service. Regarding the generated Site, we grant you a license to use it for your business while you maintain an active Plan under these Terms.

10.2 Platform

The software, brand, interface design, prompts, flows, code, and other proprietary elements of CreateWebToday belong to us or our licensors. You acquire no rights in them by using the Service. If you send feedback or suggestions, we may use them to improve the Service without obligation to compensate you.

10.3 Third-party content

You must not upload or publish material that infringes copyright, trademarks, privacy, or any applicable law.

11. Acceptable use

You may not use CreateWebToday for:

• Illegal, fraudulent, deceptive, or phishing activities.
• Hate, violence, exploitation, spam, malware, or other unlawful material.
• Impersonation or systematically falsifying contact information.
• Attempting to breach security, abusive scraping, overloading infrastructure, or circumventing AI limits or other technical controls.
• Reselling the Service as a white-label platform without prior written authorization.

We may remove content, suspend Sites, or close accounts that violate these rules or create legal risk for CreateWebToday or third parties, without obligation to refund.

12. Your compliance obligations

You are responsible for ensuring that your business, Site, and User Content comply with applicable laws (including advertising, consumer protection, personal data you collect on your page, and rules of your trade). CreateWebToday is not your legal advisor and does not guarantee that compliance.

13. Support, availability, and third parties

We provide reasonable email support. There is no SLA and no guaranteed response time or uptime. We may update features, AI models, providers, or operational flows at any time.

The Service depends on third parties (for example Cloudflare, Stripe, OpenAI, and registrars). Interruptions, errors, or delays by those parties, or force majeure beyond our reasonable control, do not create liability or an automatic right to refund or compensation from CreateWebToday.

14. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without express or implied warranties of merchantability, fitness for a particular purpose, freedom from errors, continuity, absolute security, or business results.

15. Limitation of liability

To the maximum extent permitted by applicable law, CreateWebToday will not be liable for direct, indirect, incidental, special, punitive, or consequential damages, lost profits, data loss, loss of goodwill, Service interruptions, third-party failures, errors or omissions in AI-generated Content, or for content you publish or decisions you make based on it.

Nothing in these Terms obligates CreateWebToday to indemnify or compensate you for use of the Service beyond what a mandatory applicable rule unavoidably requires. If any provision is unenforceable, the remainder remains in effect.

16. Indemnification

You agree to defend, indemnify, and hold harmless CreateWebToday, its operators, collaborators, and providers from claims, damages, fines, costs, and attorneys’ fees arising from: (a) your User Content or what you publish; (b) your business or use of your Site; (c) your domain or registrant data; (d) your breach of these Terms or the law; or (e) third-party claims for infringement or misuse of the Service attributable to you.

17. Suspension and termination

We may suspend or terminate your access, Sites, or account—with or without prior notice depending on severity—if you breach these Terms, there are signs of fraud or abuse, or there is legal, security, or third-party risk. In those cases there is no refund obligation. You may stop using the Service and cancel auto-renewal at any time from your dashboard.

18. Changes to these Terms

We may update these Terms at any time. The current version and its date are published on this page. Continued use of the Service after a change constitutes acceptance. If you disagree, you must stop using the Service and cancel auto-renewal.

19. General provisions

• These Terms, together with the Privacy Notice and Cookie Policy, constitute the entire agreement regarding the Service.
• If any clause is held invalid, the others remain in force.
• Failure to enforce a right does not waive that right.
• You may not assign these Terms without our prior consent. We may assign them in connection with a reorganization, merger, or sale of the business.
• Nothing in this document creates a partnership, agency, or employment relationship between you and CreateWebToday.

20. Governing law and venue

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Subject to any mandatory consumer-protection rights that cannot be waived in your country of residence, the parties submit to the exclusive jurisdiction of the state and federal courts located in Delaware for disputes arising from these Terms or the Service.
